  1.                  FINAL ACT EMBODYING THE RESULTS OF THE
  2.             URUGUAY ROUND OF MULTILATERAL TRADE NEGOTIATIONS

  5. 1.    Having met in order to conclude the Uruguay Round of Multilateral 
  6. Trade Negotiations, the representatives of the Governments and of the 
  7. European Communities, members of the Trade Negotiations Committee 
  8. (hereinafter referred to as "participants"), agree that the Agreement 
  9. Establishing the Multilateral Trade Organization and the Ministerial 
  10. Declarations and Decisions, as set out in the annexes attached hereto 
  11. (hereinafter referred to as "instruments"), embody the results of their 
  12. negotiations and form an integral part of this Final Act.

  14. 2.    By adopting the present Final Act, participants agree 
  15.  
  16.       (a)  to adopt the Ministerial Declarations and Decisions;  and
  17.  
  18.       (b)  to submit, as appropriate, the Agreement Establishing the 
  19.            Multilateral Trade Organization for the consideration of their 
  20.            respective competent authorities with a view to seeking approval 
  21.            of this Agreement in accordance with appropriate procedures of 
  22.            the participant concerned.

  24. 3.    Participants agree on the desirability of acceptance of the Agreement 
  25. Establishing the Multilateral Trade Organization by all participants with a 
  26. view to its entry into force as early as possible and not later than [1 July 
  27. 1995].  Not later than [early 1995], Ministers will meet, in accordance with 
  28. the final paragraph of the Punta del Este Ministerial Declaration, to decide 
  29. on the international implementation of the results including the timing of 
  30. their entry into force.

  32. 4.    Participants agree that the Agreement Establishing the Multilateral 
  33. Trade Organization shall be open for acceptance as a whole, by signature or 
  34. otherwise, by all participants in the Uruguay Round of Multilateral Trade 
  35. Negotiations pursuant to Article XIV of the Agreement Establishing the 
  36. Multilateral Trade Organization.  The acceptance and entry into force of a 
  37. Plurilateral Trade Agreement, included in Annex 4 of the Agreement 
  38. Establishing the Multilateral Trade Organization, shall be governed by the 
  39. provisions of that Agreement.

  41. 5.    Before accepting the Agreement Establishing the Multilateral Trade 
  42. Organization, participants who are not contracting parties to the GATT 1947 
  43. must first have concluded negotiations for their accession to the GATT 1947 
  44. and become contracting parties thereto.  For participants who are not 
  45. contracting parties to the GATT 1947 as of the date of the Final Act, the 
  46. Schedules are not definitive and shall be subsequently completed for the 
  47. purpose of their accession to GATT 1947 and acceptance of the Agreement 
  48. establishing the MTO.

  50. 6.    This Final Act and the texts of the instruments set out in the Annexes 
  51. shall be deposited with the Director-General to the CONTRACTING PARTIES to 
  52. the General Agreement on Tariffs and Trade who shall promptly furnish to 
  53. each participant in the Uruguay Round of Multilateral Trade Negotiations a 
  54. certified copy thereof.
